Whether your spouse is outside the UK, and you would like them to join you, or they are in the UK, however, their current leave is expiring, we can assist you with the relevant application, simultaneously ensuring that they meet the requirements under the Appendix FM.

Spouse / Fiancé outside the UK – Requirements Overview

  • Must be outside the UK
  • Must not fall for refusal under the suitability sections of Appendix FM
  • Both you and your spouse must meet the relationship requirement
  • You must meet the financial (the minimum income threshold is £18,600)
  • And accommodation requirements
  • Your spouse must satisfy the criteria of the English language requirement

Please note for the fiancé visa, the entry process is different, as you fiancé will be granted 6 months initially. Within this time frame you will need to get married, and thereafter make an application for further leave to remain.

Spouse is in the UK – Requirements Overview

  • Must have valid leave to remain
  • Must not fall for refusal under the suitability sections of Appendix FM
  • Both you and your spouse must meet the relationship requirement
  • The financial (the minimum income threshold is £18,600)
  • And accommodation requirements must be met. Please note if your spouse is employed, their earnings can be included.
  • Your spouse must satisfy the criteria of the English language requirement

Please note that if your spouse does not meet one of the requirement, your spouse can apply for further leave to remain, under EX of the Appendix FM, and Article 8 of the ECHR.
